Terms and Conditions

Last updated: on publication. These Terms govern your access to and use of dc-labx.com (the "Site") and any purchase from DC Laboratory ("DC LABX", "we", "us"). By using the Site or placing an order you agree to these Terms. If you do not agree, do not use the Site.

1. Eligibility

You may use the Site only if you are at least 18 years old and have legal capacity to contract. Certain products carry a higher minimum age, stated on the product page and confirmed at checkout. We may refuse or cancel any order at our discretion, including where we believe these Terms have been breached.

2. Nature of the products

Read this section carefully. It defines what you are buying.

Products listed on the Site are supplied as laboratory reference materials, raw materials or documented wellness products, according to the classification shown on each product page. Unless a product page expressly states otherwise, products are:

• not medicines, and hold no marketing authorisation from any medicines regulator;
• not intended for human or veterinary consumption, ingestion, injection or application;
• not supplied for diagnosis, treatment, cure or prevention of any disease or condition;
• intended for use only by suitably qualified persons or institutions, in appropriately equipped facilities.

Where a product page states "Research Use Only" or "Not for human consumption", that statement is a condition of sale, not a formality.

3. No medical advice and no claims

Nothing on the Site is medical, clinical, pharmaceutical or professional advice, and nothing on the Site is a substitute for consultation with a qualified healthcare professional. We make no claim that any product diagnoses, treats, cures, prevents or improves any disease, condition or outcome. Any information published about a product is limited to what has been documented and internally reviewed.

You must not rely on the Site in making any health decision. If you have a health concern, consult a qualified healthcare professional.

4. Product availability and compliance status

Every product carries an internal compliance status. Only products expressly approved for online sale can be purchased. Products under review, restricted, enquiry-only or unpublished are not available for purchase and any apparent ability to order them is an error, which we may correct by cancelling the order and refunding the amount paid.

We may change, suspend, restrict or withdraw any product at any time, including after an order is placed and before it ships.

5. Your responsibilities and assumption of risk

By purchasing, you represent, warrant and undertake that:

1. you are acquiring the product for a lawful purpose permitted in your jurisdiction;
2. you are qualified, equipped and authorised to handle the product safely;
3. you will not consume, ingest, inject or administer the product to any human or animal unless the product page expressly states it is authorised for that use in your jurisdiction;
4. you will not resupply, resell or distribute the product in breach of any applicable law;
5. you have satisfied yourself that the product may lawfully be imported into, and possessed in, your country;
6. all information you give us, including your delivery address and any age or eligibility confirmation, is accurate.

You assume all risk arising from your handling, storage, use or disposal of the product, and from any use inconsistent with these Terms.

6. International orders, customs and import

Where we ship internationally, you are the importer of record. You alone are responsible for:

• determining whether the product may lawfully be imported into your country;
• all duties, taxes, customs charges, brokerage and clearance fees;
• providing any documentation, licence or permit your authorities require.

We are not responsible for goods seized, detained, destroyed or returned by customs or any other authority, and no refund is due in those circumstances except where required by law. Delivery estimates are estimates only and exclude time in customs.

7. Orders, pricing and payment

Product listings are an invitation to treat, not an offer. A contract forms only when we confirm your payment. We may correct pricing or description errors and cancel affected orders with a refund.

Where you pay by manual bank transfer: uploading a payment receipt does not confirm payment. Your order is processed only after we verify the transaction in our receiving bank account. Orders unpaid by the stated deadline are cancelled automatically and any reserved stock is released.

8. Disclaimer of warranties

To the maximum extent permitted by applicable law, the Site and all products are provided "as is" and "as available", and we exclude all warranties, conditions, representations and terms whether express, implied or statutory, including any implied warranty of merchantability, satisfactory quality, fitness for a particular purpose, non-infringement, accuracy, or that the Site will be uninterrupted or error-free.

9. Limitation of liability

To the maximum extent permitted by applicable law:

1. we are not liable for any indirect, incidental, special, consequential, exemplary or punitive loss, or for any loss of profit, revenue, business, goodwill, opportunity, data or anticipated saving, however arising;
2. we are not liable for any loss, injury, damage or liability arising from your handling, storage, use, misuse or disposal of a product, from any use inconsistent with these Terms, or from any decision you take based on the Site;
3. our total aggregate liability arising out of or in connection with these Terms, the Site and any product, whether in contract, tort (including negligence), breach of statutory duty or otherwise, is limited in aggregate to the amount you actually paid for the specific product giving rise to the claim.

Nothing in these Terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any other liability that cannot lawfully be excluded or limited. Where you deal as a consumer, your statutory rights are unaffected, and if any exclusion above is unenforceable in your jurisdiction it applies only to the extent permitted there.

10. Indemnity

You agree to indemnify and hold harmless DC Laboratory, its officers, employees and agents against all claims, liabilities, losses, damages, penalties, fines and costs (including reasonable legal fees) arising from or connected with: your breach of these Terms; your handling, use, misuse, resupply or disposal of any product; your breach of any law or regulation, including import, export and medicines law; or any inaccurate information you provide.

11. Returns

Certain product categories cannot be returned once dispatched, for safety and traceability reasons. See our Returns and Refund Policy. Nothing in this section affects any non-excludable statutory right you may have as a consumer.

12. Intellectual property

All content on the Site, including text, imagery, branding and layout, belongs to DC Laboratory or its licensors and may not be reproduced without written permission.

13. Suspension and termination

We may suspend or terminate your access, cancel orders or refuse future orders where we reasonably believe you have breached these Terms or applicable law.

14. Changes

We may amend these Terms at any time by publishing a revised version. The version in force when you place an order governs that order.

15. Governing law and severability

These Terms and any dispute arising from them are governed by the laws of Malaysia, and you submit to the non-exclusive jurisdiction of the Malaysian courts, without prejudice to any mandatory consumer protection you enjoy in your country of residence. If any provision is held unenforceable, the remainder continues in full force and the unenforceable provision is applied to the maximum extent permitted.
